USDA weakens school nutrition standards

The USDA has announced some changes to the school food rules implemented in the previous administration.  The USDA press release explains:

  • First, it will broaden the milk options in the National School Lunch Program and School Breakfast Program by allowing local operators to permanently offer flavored, low-fat milk. For consistency across nutrition programs, it will also allow flavored, low-fat milk in the Special Milk Program for Children and in the Child and Adult Care Food Program for participants ages 6 and older. [My translation: a green light to sugar-sweetened milk].
  • Second, this final rule will require that half of the weekly grains in the school lunch and breakfast menu be whole grain-rich, thus ending the need for the exemption process. [Translation: Schools can serve a lot fewer whole-grain foods].
  • Third, it will provide schools in the lunch and breakfast programs more time for gradual sodium reduction by retaining Sodium Target 1 through the end of school year (SY) 2023-2024, continuing to Target 2 in SY 2024-2025, and eliminating the Final Target that would have gone into effect in SY 2022-2023. [Translation: Good-bye Target 3; forget about serious sodium reduction].

By codifying these changes, USDA acknowledges the persistent menu planning challenges experienced by some schools, and affirms its commitment to give schools more control over food service decisions and greater ability to offer wholesome and appealing meals that reflect local preferences.  [Translation: USDA is committed to letting schools serve junk foods].

It’s worth reading the Federal Register notice:, which reveals:

  • 97% of more than 84,000 comments on grain flexibility opposed the changes.
  • 96% of more than 83,000 comments on sodium flexibility opposed the changes.

Most schools had implemented the previous rules just fine.  In today’s Orwell-speak, greater “flexibility” means that USDA cares a lot more about the health of the companies that sell meals and snacks to schools than it does to kids’ health.

These changes provide further evidence of corporate capture of USDA.

USDA makes school meals more flexible (translation: less nutritious)

The USDA announces its revised school meal rules, in words that would make George Orwell proud:

The U.S. Department of Agriculture (USDA) today provided local food service professionals the flexibility they need to serve wholesome, nutritious, and tasty meals in schools across the nation. The new School Meal Flexibility Rule…reflects USDA’s commitment, made in a May proclamation to work with program operators, school nutrition professionals, industry, and other stakeholders to develop forward-thinking strategies to ensure school nutrition standards are both healthful and practical…This action reflects a key initiative of USDA’s Regulatory Reform Agenda, developed in response to the President’s Executive Order to alleviate unnecessary regulatory burdens.

Try and get your head around this.  The revised rules make school meals less nutritious.  They allow schools to:

  • Serve flavored rather than plain low-fat milk (higher in sugar)
  • Be exempt from serving whole grain-rich products.
  • Have until the end of the 2020-2021 school year to reduce the salt in school meals.

This rule will be in effect for SY 2018-2019. USDA is accepting public comments for longer term use at www.regulations.gov.

I will never understand why adults would lobby to make school meals less healthful, but here is the School Nutrition Association praising the changes.  The Association cites survey data indicating that 65 percent of school districts are having trouble with whole grains and 92 percent with sodium requirements.

The proposal is a hammer in search of a nail…Virtually 100 percent of schools are already complying with the final nutrition standards, including the first phase of sodium reduction.

What ag schools really need to teach: a report

The Association of Public Land-Grant Universities has just released a report titled “Challenge of Change” about how the USDA can do a better job of funding research to solve important problems in food and agriculture.

The challenge:

 

Traditionally, the effort to achieve food security has been largely focused on the need to increase yields in order to produce more food. There is now broad recognition that production alone will not solve the grand challenge. All aspects of our food systems must be considered: nutrition, food safety, food loss, economic costs, individual behaviors, incentive structures, and societal factors affect not only production, but also access and utilization. There is also now an understanding that production increases must be achieved in the context of water availability, energy limitations, and environmental impact.

The report concludes that universities will need to change, so as to:

  • Elevate Food and Nutrition Security to a Top Priority
  • Align University Resources and Structures for Transdisciplinary Approaches
  • Enhance and Build University-Community Partnerships
  • Educate a New Generation of Students to be Transdisciplinary Problem Solvers

To achieve food security, food and agriculture will need to change to:

  • Broaden the Focus Beyond Yields
  • Change the Food System’s Incentive Structure
  • Develop the Capacity of Universities in Low-Income Countries
  • Leverage Technology, Big Data, and Information Science Information

This is an important report because it comes from land-grant universities .  These are currently responsible for supporting industrial agricultural systems and virtually ignoring—or firmly opposing—sustainable agricultural production methods.

A challenge for change indeed.  I hope land-grant universities listen hard.

USDA finalizes school food rules: Applause!

Last week, the USDA sent out a press release announcing the last four Final Rules for school meals under the Healthy, Hunger-Free Kids Act (HHFKA) of 2010:

You probably won’t want to read all the fine print.  Fortunately, others have done just that.

  • Wellness policies will be required to prohibit on-campus marketing of foods and drinks that fail to meet the Smart Snacks nutritional standards.
  • Whether companies can market “copycat” snacks in schools (Smart Snacks-compliant versions of junk food available in supermarkets) is left up to local districts.
  • Also left to local districts are policies about incentive programs, such as Box Tops for Education or fast food coupons passed out to kids for reading books.
  • School wellness policies will be required to set nutritional standards for foods and drinks offered to kids at classroom parties or by teachers as treats, but districts can determine the actual policies.
  • Schools will be allowed to sell hard-boiled eggs, low-sodium canned vegetables, and peanut butter and celery.

Her bottom line:

With the finalization of these four rules, the historic work of the Obama administration in improving children’s school food environment is now complete. But, of course, we’re already one year overdue for the next CNR [Child Nutrition Reauthorization], a process which could easily roll back or weaken these reforms – many of which have already been overtly threatened by House Republicans.

CSPI’s Take on What’s New

  • Local wellness policies must address marketing of foods and drinks that do not meet the Smart Snacks standards.
  • Local wellness policies must involve the public and school community and produce an annual progress report.
  • Local wellness policies must designate a school official for compliance and undergo administrative review every 3 years.
  • School districts must update goals for nutrition promotion, nutrition education, physical activity, and school wellness activities based on evidence-based strategies.

CSPI says the new rules mean local wellness policies can and should:

  • Shift unhealthy school fundraisers to profitable healthy food or non-food fundraisers
  • Ensure that school celebrations support healthy eating and physical activity
  • Use non-food rewards
  • Provide ample opportunities for physical activity, quality physical education, and recess

My comments

Nutritionism: Many of the complaints about USDA’s nutrition standards derive from their focus on single nutrients—fat, salt, sugar—rather than on foods. Boiled eggs weren’t allowed because of their fat and cholesterol content, but copy-cat snack foods were.  If the standards applied to minimally processed whole foods, they would make more sense. USDA now has to take comments on whether to eliminate the standard for total fat from Smart Snacks because of the egg issue and the confusing nature of current research on saturated fat (also a problem resulting from studying one nutrient at a time).

Politics:  Regardless of how trivial some of these rules may appear, USDA’s school food standards must be considered an extraordinary achievement.  Against all odds—unrelenting opposition from companies that supply junk food to schools, Congress, and, weirdly, the School Nutrition Association—the new rules will improve the nutritional quality of school meals and snacks, at least most of the time.  School districts with officials who care deeply about improving the food served to kids now have a mandate to do so.  Those who don’t will have a harder time doing a bad job.  Applause to USDA for bringing the rules to closure.  May they survive the next round of lobbying.

PAHO issues nutrition standards for ultraprocessed foods. Beverage Associations object.

Cheers to the Pan American Health Organization/World Health Organization for releasing nutritional profile standards for making it easier for governments to distinguish fresh and minimally processed foods from ultraprocessed.  The idea here is to encourage populations to consume traditional diets (see press release).

Ultra-processed foods are defined as industrially formulated food products that contain substances extracted from foods (such as casein, milk whey, and protein isolates) or substances synthesized from food constituents (such as hydrogenated oils, modified starches, and flavors). Drawing on the best scientific evidence available, the model classifies processed and ultra-processed foods and beverages as having “excessive” amounts of sugar, salt and fat according to the following criteria:

  • Excessive sugar if the amount of added sugars is 10% or more of total calories
  • Excessive fat if the calories from all fats are 30% or more of total calories
  • Excessive saturated fat if calories from saturated fats are 10% or more of total calories
  • Excessive trans fat if calories from trans fats are 1% or more of total calories
  • Excessive sodium if the ratio of sodium (in milligrams) to calories (kcal) is 1:1 or higher.

PAHO’s point in setting these standards is to encourage governments to:

  • Restrict the marketing of unhealthy food and beverages to children (see PAHO Plan of Action for the Prevention of Obesity in Children and Adolescents)
  • Regulate school food environments (feeding programs and food and beverages sold in schools)
  • Use front-of-package (FOP) warning labels
  • Define taxation policies to limit consumption of unhealthy food
  • Assess agricultural subsidies
  • Identify foods to be provided by social programs to vulnerable groups.

Yes!

Alas, not everyone is as enthusiastic as I am about the profiles.  The International Council of Beverages Associations released this statement:

We agree that obesity is a global health challenge, and ICBA and its members welcome the opportunity to work with PAHO and other stakeholders to pursue effective and practical solutions. There are some areas, however, where we believe that use of PAHO’s Nutrient Profile Model may not provide helpful guidance to consumers.  There is not current scientific consensus in all areas that the Nutrient Profile Model addresses. It will not be useful if families find that nearly 80% of the foods and beverages in their grocery carts are unacceptable. Such a radical message is not likely to be followed by most individuals…we encourage governments and scientific bodies to offer food and dietary recommendations and national policies that are based on the totality of scientific evidence and provide realistic, positive encouragement to consumers to have a real impact promoting healthful diets and preventing obesity and non-communicable diseases.

 

The PAHO profiles may need tweaking, but they are a great first step.  Now let’s see how they get implemented.

Viewpoint: Food-industry Funding of Food and Nutrition Research

My latest Viewpoint, “Corporate funding of food and nutrition research: science or marketing,” was published yesterday in JAMA Internal Medicine 2016;176 (1):13-14.  doi:10.1001/jamainternmed.2015.6667.

The longstanding influence of food industry funding on nutrition research, researchers, and professional societies1 threatens the credibility of nutrition science. So much research is sponsored by industry that health professionals and the public may lose confidence in basic dietary advice. Although most journals now require authors to disclose who pays for their work, disclosure—even done diligently—is not sufficient to alert readers to the extent to which industry funding influences research results and professional opinion. As is well established from experimental and observational research, drug company gifts and grants can have substantial effects. To recipients, however, these effects are almost always unconscious, unintentional, and unrecognized, making them especially difficult to prevent.

Medical schools and medical journals have increased efforts to minimize and manage conflicts of interest with industry. But from my observations, nutrition researchers, journals, and professional societies, like medical researchers, often fail to realize that food-industry funding may affect their work and its credibility.

Two recent investigative articles in the New York Times illustrate the concerns about biases introduced by industry funding. The first3 described the support by Coca-Cola of academic researchers who founded a new organization, the Global Energy Balance Network, to promote physical activity as a more effective method than calorie control (eg, from avoiding sugary sodas) for preventing obesity. The second4 analyzed emails obtained through open-records requests to document how Monsanto, the multinational agricultural biotechnology corporation, on the one hand, and the organic food industry, on the other, recruited professors to lobby, write, and testify to Congress on their behalf.

Both articles3,4 quoted the researchers named in these reports as denying an influence of industry funding and lamenting the paucity of university research funds and the competitiveness of federal grants. Despite leaving their organizations open to accusations that they have sold out to industry,5 officers of nutrition research societies tell me that they cannot function without industry funding of journals and conferences. They have a point. Although the investment by federal agencies in food and nutrition research has increased steadily since the early 1990s, US Department of Agriculture grants are diminishing, and the National Institutes of Health are funding fewer researchers at state agricultural colleges. Investigators have a hard time obtaining grants for projects related to food composition, food technology, nutrients, and nutrient metabolism as federal agencies have understandably shifted priorities toward research on obesity, genetics, and chronic diseases.6

Food companies, such as Quaker Oats, used to support basic research conducted by in-house scientists, but Unilever and Nestlé (no relation) are among the very few companies that continue to do so. Instead, food companies outsource research, much of which can appear as designed for marketing purposes. Recently, in preparation for what I intend to be a more systematic analysis of corporate funding of nutrition research, I began collecting a convenience sample of studies funded by food and beverage companies or trade associations as they appear in journals I happen to be reading. I sort them by whether their results do or do not favor the interests of the sponsor, and post examples online at my blog, https://foodpolitics.com.7

Between March and October 2015, I identified 76 industry-funded studies. Of these, 70 reported results favorable to the sponsor’s interest. Despite ongoing requests to readers of my blog to help me identify funded studies reporting results contrary to a funder’s interest, I have found only 6.  [Note: Since writing this, the score has gone to 90:9.] This discrepancy is consistent with the results of systematic investigations of industry sponsorship, such as one on the role of sugar-sweetened beverages in obesity.8 In general, independently funded studies find correlations between sugary drinks and poor health, whereas those supported by the soda industry do not.9 In the studies I collected, companies or trade associations promoting soft drinks, dairy foods, eggs, breakfast cereals, pork, beef, soy products, dietary supplements, juices, cranberries, nuts, and chocolates supported the study itself, the investigators, or both. These studies all found significant health benefits or lack of harm from consuming the foods investigated, results that can be useful for deflecting criticism of a company or promoting its products.

Mars Inc, for example, the maker of chocolate candies such as M&Ms, funds studies on the effects of cocoa flavanols on arterial function and blood pressure. One such study, published in September 2015,10(p1246)concluded that these compounds “improved accredited cardiovascular surrogates of cardiovascular risk, demonstrating that dietary flavanols have the potential to maintain cardiovascular health even in low-risk subjects.” The study investigators,10 one of whom is employed by Mars, followed well-established scientific protocols in conducting the research. Science is not the issue here. Marketing is the issue. The question is why Mars would fund a study like this and assign one of its employees to help design and write it. In this instance, the answer is obvious. Mars issued a press release “Cocoa flavanols lower blood pressure and increase blood vessel function in healthy people,” and noted these results in a full-page advertisement in the New York Times on September 27, 2015, Neither the press release nor advertisement explained that cocoa flavanols are largely destroyed during all but the most careful processing of chocolate, nor did they mention chocolate at all. They didn’t have to. Uncritical readers are likely to interpret the statements as evidence that chocolate is good for them and that its sugar and calories can be ignored.

The second New York Times article4 raised more insidious concerns about industry involvement with scientists, using Monsanto and organic food companies as cases in point. Although both industries recruit scientists to speak on their behalf, Monsanto has far greater resources. In 1994, I was a member of the Food Advisory Committee to the US Food and Drug Administration (FDA) when that agency approved genetically modified (GM) foods. I observed how Monsanto-funded scientists convinced the FDA that labeling GM foods would be misleading.

Confronted with increasing public support for labeling foods that are produced with GM ingredients, the biotechnology industry supported—and the House of Representatives passed—H.R. 1599 in July 2015. This bill, expected to be considered by the Senate before the end of 2015, has the Orwellian title, “The Safe and Accurate Food Labeling Act,” but some critics call it the “Denying Americans the Right to Know (DARK) Act.” Proposed by Representative Mike Pompeo (Kansas) on the basis that GM foods are safe and, therefore, acceptable, the act would block states from enacting labeling laws (as Vermont has already done) and permit GM foods to be labeled as “natural.” Opponents question the safety of GM foods. But they also raise additional reasons for full transparency in labeling—patents, control of seed stocks, the widespread application of chemical herbicides to GM crops, and the increasingly widespread resistance of weeds to those herbicides. When evaluating conflicting scientific and policy arguments about GM foods, it is useful to know who funds the researchers and their studies.

Should nutrition researchers and professional societies accept funding from food companies? Not without careful thinking. It’s time that food and nutrition researchers and societies recognize the influence of food-industry sponsorship, take steps to control its effects, and ensure that sponsored studies promote public health, not the marketing of food products. Journal editors should ensure that editors and members of editorial boards are free of industry conflicts, require peer reviewers to note food-industry funding in manuscript evaluations, and be wary of accepting industry-funded publications with evident commercial implications. If food companies and trade associations want to fund research, they should consider pooling resources and setting up an independent foundation to administer the grants. Everyone involved in this system should be doing everything possible to advocate for more research funds from federal granting agencies. Nothing less than the credibility of nutrition research and advice is at stake.

Sugars for toddlers: an invitational roundtable from The Sugar Association

This week, I’m going to be posting items about sugar politics.

Item on sugars #1:

Funny thing.  I was not invited to this event, but someone who was invited passed along the invitation.  You too will be sad you weren’t invited.

I am contacting you at the request of Dr. Courtney Gaine, VP of Scientific Affairs from The Sugar Association, regarding an invitational roundtable on The Role of Sugars in Supporting a Nutrient-dense Diet for Toddlers, 12 to 24 Months.  It will be sponsored by the University of Colorado, Anschutz Medical Campus, Department of Pediatrics, chaired by Dr. Ronald Kleinman from Harvard Medical School, co-chaired by Dr. Frank Greer from the University of Wisconsin School of Medicine, and facilitated by Sylvia Rowe.  The roundtable is supported by an unrestricted educational grant from the Association….

Roundtable Objectives

  • Provide a forum to discuss the science and research voids on the role of sugars as a strategy that may help parents successfully transition their older infants and toddlers (12 to 24 months) from complementary infant foods to consuming a variety of nutrient-dense foods from the family table.
  • Generate potential research ideas and questions on this topic for future guidance on the feeding of young children, including birth to 24 months, which is scheduled for integration into the 2020 Dietary Guidelines for Americans.
  • Create the impetus to extend this research to public-private partnerships with industry, academy and the government.

Proposed Topic Areas 

  • The roundtable has been tentatively divided into these 5 topic areas: 1) transitional toddler feeding and nutrition policy; 2) physiology; 3) sugars in toddler feeding practices; 4) parent-feeding strategies: emerging science; and 5) the research path forward….

Honorarium 

The Sugar Association will reimburse you for all reasonable travel expenses, plus a $2,000 honorarium for your review of abstracts and presentations, which you will receive in mid-October, and your participation in the 1 ½ day roundtable.

This requires some translation.  I may be over-interpreting here, but as I see it, the Sugar Association is paying academics $2000 to implicitly endorse:

  • Promoting the use of sugar as a way to get toddlers to eat healthier foods.
  • Making sure the 2020 dietary guidelines say nothing about the need for kids to eat less sugar (we don’t even have the guidelines for 2015 yet).
  • Making sure that government agencies don’t advise or set policies to encourage eating less sugar.

Sigh.

Update on the school meal situation

School is starting and the school food debates will no doubt be starting up again.

The USDA has a new report on what’s happening with adoption of the new nutrition standards.

  • A national study of elementary school principals and foodservice managers finds the majority (63%) to agree or strongly agree (7%) that students seem to like the new lunches.
  • The participation rate for paid school lunches declined from FY 2008 through FY 2014, with steeper declines during FY 2012-2014.  This could be do to the changes in standards but is more likely the result of higher prices charged for meals.
  • Smaller, more rural, and wealthier districts had the most difficulty adopting the new meal standards. Higher meal prices affected smaller and more rural districts.

The 2015 School Food Poll conducted by the Kellogg Foundation just reported:

  • 90% of respondents support the national school nutrition standards.
  • 86% say the school nutrition standards should stay the same or be strengthened.
  • 91% say kids need access to safe drinking water in schools.
  • 88% support increased government funding to expand farm to school programs.
  • 84% believe sustainable agriculture should be part of the Dietary Guidelines for Americans.

The Kellogg Foundation provides

My interpretation: The nutrition standards are working well enough but it’s time to advocate even more strongly for universal school meals.  It’s absurd and unconscionable that poor kids are getting priced out of school meals.

Addition: The School Nutrition Association, the group doing everything it can to undermine the new nutrition standards, has just issued a report finding that the standards have caused severe financial harm to 70% of schools.  The reason?

There is strong consensus as to the leading reason for the decline in lunch ADP: decreased student acceptance of meals [.underlined in report].

The report does, however, provide a table of reasons for increased costs:

  • Increased per meal food costs — 70.1%
  • Decreased lunch participation — 56.8%
  • Decreased a la carte revenue — 53.0%
  • Increased labor/benefits costs — 48.5%
  • Declining student enrollment — 20.6%

Given these results, you might think the SNA would be lobbying night and day for higher reimbursement rates, but no such luck.  The SNA is lobbying for weaker standards.  Pity.

Addition, August 25:  A study from the University of Vermont finds school kids to be consuming slightly fewer servings of fruits and vegetables since the nutrition standards were implemented and to be producing 56% more plate waste.  This is not good news.

Addition, August 28:  But a CDC study finds that in 2014, schools were making significant progress:

  • Almost all schools offered whole grain foods each day for breakfast (97.2%) and lunch (94.4%)
  • Most schools offered two or more vegetables (79.4%) and two or more fruits (78.0%) each day for lunch.
  • Approximately one third (30.5%) of schools offered self-serve salad bars.
  • Among the 55.0% of schools that prepared food at the school, about half were trying hard to reduce salt.
  • Overall, 97.5% of schools used at least one of the nine school nutrition services practices examined, with 23.9% using one to three of the practices, 48.3% using four to six of the practices, and 25.3% using seven or more of the practices.

My interpretation: Schools are moving to adopt the new nutrition standards.  Some are succeeding better than others.  The outcome of studies therefore depends on whether you see the glass as half full, or empty.
