The FDA needs to take action on food dyes

Bettina Siegel’s Lunch Tray blog had an item recently about a new report on the effects of food dyes on children’s behavior (her blog is behind a Substack paywall, but well worth the subscription).

This report makes it time to talk about food dyes again.  For starters, they have only one purpose: to sell ultra-processed (junk) foods.  Research shows that brightly colored candy, snacks, and sodas are perceived as tasting better than the grey alternatives.  The food industry needs cosmetic food dyes.  We don’t, especially if they are harmful.

The 311-page peer-reviewed report, from the California Environmental Protection Agency’s Office of Environmental Health Hazards Assessment (OEHHA), is a meta-analysis of animal studies and 27 human clinical trials dealing with the neurobehavioral effects of seven synthetic food dyes on children.

Its conclusion:

The scientific literature indicates that synthetic food dyes can impact neurobehavior in some children… current ADIs [FDA’s Acceptable Daily Intakes] may not provide adequate protection from neurobehavioral impacts in children. For some of the dyes… updated safe levels of exposure would be much lower.

The idea that synthetic food dyes are associated with adverse neurobehavioral outcomes in children, but that children vary in their sensitivity to these dyes, is hardly new information.

In the mid-1970s, the physician Ben Feingold associated food dyes with hyperactivity in children and developed the Feingold Diet to improve kids’ behavior.

Scientists’ attempts to study the effects of food dyes gave mixed results.  For example, as I wrote in a blog post on March 31, 2011, consider two studies published by Science magazine in 1980:

  • Researchers gave pills containing a mix of food additives to 40 children, 20 diagnosed as hyperactive and 20 not.  The children diagnosed with hyperactivity reacted to the food additive challenge but the other children did not (Science 1980;207:1485-87).  But this study used pills rather than foods, mixed additives, and used questionable methods for evaluating hyperactive behavior.
  • Researchers attempted to correct for such problems by using two drinks that looked and tasted the same—one contained seven food colors while the other did not.   The study was designed carefully such that neither the kids, parents, or observers knew what the kids were drinking.  The result:  Twenty of the 22 kids showed no reaction to the dyes.  One child reacted to the dyes every time (Science 1980;207:1487-89).

The interpretation?  Some kids may react to food dyes.

This gave the FDA an excuse to do nothing.  But then,

So how safe are they? “Color additives are very safe when used properly…There is no such thing as absolute safety of any substance. In the case of a new color additive, FDA determines if there is ‘a reasonable certainty of no harm’ under the color additive’s proposed conditions of use.”

Yes, color additives are safe when they are used in accordance with with FDA regulations…our regulations specify:

  • the types of foods in which it can be used,
  • any maximum amounts allowed to be used, and
  • how the color additive should be identified on the food label.

The FDA has reviewed and will continue to examine the effects of color additives on children’s behavior. The totality of scientific evidence indicates that most children have no adverse effects when consuming foods containing color additives, but some evidence suggests that certain children may be sensitive to them…Parents who wish to limit the amount of color additives in their children’s diet may check the food ingredient list on labels. Parents should also discuss any concerns with their family physician.

Well good luck with that.  The FDA can and should do better.

The bottom line: Food dyes have no health benefits.  Kids don’t need to be eating ultra-processed foods anyway.  They will not be harmed by avoiding food dyes.

Given all of this, it’s surely time for the FDA to take some action.

Weekend reading: the history of pigs in America

J.L. Anderson.  Capitalist Pigs: Pigs, Pork, and Power in America.  West Virginia University Press, 2019.

I saw this book in the office of my food historian colleague, Amy Bentley, and snatched it up.

I love the title.

The book is a well researched history of pigs, feral and domestic, in the United States, from colonial times to the present, from free-range to CAFO, from waste as fertilizer to waste lagoons, and from lard to lean.

The book is fabulously illustrated with dozens of reproductions of etchings, drawing, and photographs of pigs in all their glory, as well as their confinement and butchery.

If you want to know how pigs arrived in America, how farmers treated them, how their numbers grew, and their place in U.S. diets, this book has it all.

But for me, the title is the best part of this book.  I was disappointed in its lack of a more forceful discussion of how pigs exemplify larger issues of corporate power and capitalism in today’s society.  The index has not one listing for “capitalism,” “neoliberalism,” or “pig industry.”

Unless I missed others, only two sentences bear directly on “Pigs, Pork, and Power:”

What about the farmers who continue in the pig production business, including the large-scale enterprises, contractors, and independent producers?  While it is difficult to generate much sympathy for the corporate leaders and integrators who are more concerned about shareholders and the bottom line than about communities, it is important to remember that many farmers and farm wage workers care about the animals they raise and the communities in which they live (p. 220)

For a recent update on the politics of pig farming, see Charlie Mitchell and Austin Frerick’s The Hog Barons, on Vox (April 19).  This article focuses on Jeff Hansen, Iowa’s largest hog producer.

Hansen’s company, Iowa Select Farms, employs more than 7,400 people, including contractors, and has built hundreds of confinement sheds in more than 50 of Iowa’s 99 counties. Since they began to arrive in the 1990s, these sheds have provoked controversy. Citing damage to healthlivelihoodsproperty values, the environment, and the farm economy, rural communities in Iowa have campaigned fiercely against them.  While their efforts have yielded small victories, they have lost the war: The state’s hog industry, led by Hansen, has cultivated close relationships with state politicians on both sides of the aisle to roll back regulations, and confinements have flooded the countryside. The Hansen family’s charitable efforts have seemingly solidified these ties; it’s not unusual for a sitting governor to attend a charity gala thrown by the Hansens.

Feed the Truth: Draining the Swamp

Several years ago, Daniel Lubetzky, the founder of KIND bars, donated funds to create an organization, Feed the Truth, to investigate food industry influence on our food system.  I was part of a team that suggested names for members of the group’s board.  Once Lubetzky set up the funding, he has had nothing further to do with the group.  The board appointed Lucy Martinez Sullivan as its executive director.

She explains this group in a YouTube video.

As its first public action, Feed the Truth, along with Maplight, a group focused on exposing the influence of money in politics, has just published Draining the ‘Big Food’ Swamp [the Executive summary is here; the full report is here].

This report is about how the food industry exerts power.  It “exposes how the $1.1 trillion food and agriculture industry flexes its political muscle through a web of trade association lobbying and campaign spending, while operating behind the scenes to undermine public health, perpetuate inequality, and consolidate power.”

Some of the report’s findings:

  • In the last 10 years, the largest 20 food industry groups spent over 300 million dollars on federal lobbying.
  • Of nearly 6,300 food trade associations, the 20 largest spent more than 300 million dollars on federal lobbying in  the last 10 years.
  • Half of food trade lobbying came from only three groups: the National Restaurant Association, the American Beverage Association and the Consumer Brands Association.
  • The National Restaurant Association is lobbying relentlessly to block efforts to raise the national minimum wage.
  • The meatpacking industry is lobbying to keep workers on the job and to increase line speeds, despite the spread of COVID-19.
  • More than 80% of the food industry lobbyists at the largest trade associations are “revolvers,” or individuals who now lobby the officials and agencies they once worked for.
  • The top 20 food trade associations spent more in campaign donations to members of Congress who voted to overturn the election results than those that didn’t.

Feed the Truth also launched a petition calling on PepsiCo, a major member of all three of the top trade groups, to get its money out of politics.

This report is an impressive first step for this group.  I can’t wait to see what else it will do.

Fungal protein, veganism, and venture capital

I don’t usually pay attention to press releases for food products but this one caught my eye.

Just announced, Nature’s Fynd, the buzzworthy food-tech company growing a nutritional fungi protein named Fy™ that recently raised over $150M in equity and debt financing, opened preorders for a limited release for its Fy Breakfast Bundle…Nature’s Fynd is solving a massive agricultural (and business) need.

The business need I get.  As one of my readers, Kristin Ohlson pointed out, this is an example of “veganism meets venture capital.”

The agricultural need?

Their breakthrough fermentation technology only requires only a fraction of the water, land, and energy of traditional protein sources. And thanks to the natural resilience and efficiency of Fy’s base organism, they make Fy emitting 99% less greenhouse gases, and using 99% less land and 87% less water than processing beef. Plus, the products are incredibly tasty and Fy is good for your body—containing all nine essential amino acids and fiber, with no cholesterol or trans fats. It’s also vegan and certified non-GMO.

Does this remind anyone of Quorn, which the Center for Science in the Public Interest has been complaining about for years?

Despite what some of the manufacturer’s marketing materials indicated, the fungus used in Quorn is only distantly related to mushrooms, truffles, or morels. While all are members of the fungus kingdom, Quorn is made from a less appetizing fungus (or mold) called Fusarium venenatum (venenatum is the Latin word for venomous).

Fy protein comes from Fusar­i­um  flavolapis, which they got out of some Yellowstone hot spring (with permission).

I hope they have done some allergy testing.

I’d like to see the ingredient lists for some of these products.

For the moment, I’ll stick with food.

Let’s hear it for good food news: the British government wants to ban junk food marketing

Here’s the announcement in The Guardian: “UK to ban all online junk food advertising to tackle obesity:  ‘World-leading’ proposal delights health campaigners and dismays advertising industry.”

The tougher-than-expected rules came after Boris Johnson changed his view on personal health decisions following his coronavirus infection. Overweight people are at risk of more severe illness from Covid, or death. Research has found that one in three children leaving primary school are overweight, or obese, as are almost two-thirds of adults in England…If implemented, the ban would affect digital marketing, from ads on Facebook, to paid-search results on Google, text message promotions, and social media activity on Twitter and Instagram.

This refers to the UK government’s “New public consultation on total ban of online advertising for unhealthy foods.”   The details of the consultation are here.  The government wants comments on

  • what types of advertising will be restricted
  • who will be liable for compliance
  • enforcement of the restrictions

According to the BBC,

The plans will now be discussed by representatives from the food industry, members of the public and the government for six weeks, before a decision is made over whether the advert ban will happen or not.

Comment: I’ll bet this proposal does indeed ‘”dismays the advertising industry” and the food industry too.  Marketing is an enormous influence on food choice, particularly insidious because we don’t recognize marketing as such.  It’s just seen as part of the landscape and affects us at an unconscious level.  Marketing to children is especially egregious, especially because it is so effective in encouraging them to demand junk food.  Cheers to the UK government for this.  Stick with it!

This is the day to honor the farm, meatpacking, slaughterhouse, grocery,  and other low-wage food system workers deemed essential during the Covid-19 pandemic.

The Dietary Guidelines Advisory Committee reports in today

The Dietary Guidelines Advisory Committee (DGAC) meets today to talk about its draft report.  Register for it here.

Reporters tell me that the DGAC report will not be released at this meeting; it is not ready.

Here’s what today’s announcement says:

The Committee will finalize their advisory report based on Committee discussion at the meeting. They will then submit their final report to the Secretaries of USDA and HHS. USDA and HHS will post the final report online, send out a public notification, and open a new public comment period for the Departments to accept comments on the Committee’s report. This action is expected on or around July 15, 2020.

This meeting is being held despite calls for delay.  Politico’s Helena Bottemillier Evich describes these calls under “Influential groups press for delay of Dietary Guidelines” (behind a paywall at the moment).

The groups are turning up the pressure ahead of the committee’s final public meeting on Wednesday, where the panel will discuss its draft conclusion statements. The committee is then expected to release in mid-July a sweeping scientific report to advise the Agriculture Department and Department of Health and Human Services on what the 2020 iteration of the guidelines should say.

Some of the Dietary Guidelines’ staunchest allies and fiercest critics — including professional groups and low-carb advocates — are urging a delay. They note that last year’s government shutdown and the continuing pandemic have made it more difficult for the committee to complete the necessary work before advising the government on the 2020 guidelines, which will last five years.

Corporate Accountability notes the undue influence of industry on the guidelines.  One of its recent reports documents ties of DGAC members to ILSI, an industry front group.

The guidelines are subject to criticism from just about everyone (me too).  I’m interested to see what this committee does.  Stay tuned.
